At byPaper (also later referred to as we, our or us), we are dedicated to protect your personal data and respect your privacy while you are making use of our website https://www.byPaper.app, our application (“App”) or other services. This privacy policy explains how byPaper handles your personal data, why we need, use and how we store, protect and process this data.

With “Personal Data”, we refer to information that relates to an identified or identifiable individual (natural person) and can include information about how you engage with our Services (e.g. name, device information).

If you are younger than sixteen years old, you cannot use our Website, App or other services without the permission of your parents or legal guardian.

Data we may collect from you

The following (personal) data may be collected and processed, when you voluntarily provide it to us.

When an account is created and login is used

To create an account, you can choose to provide your email, password or data provided through social media login (see What data do we use from social media login).

Photos and videos for which we received permission to obtain

Photographs and video content provided by you to design your product. You must be the legitimate owner of this data when providing it to us.

Payment data required for orders

We do not see, process or store credit/debit card data. We use a payment services provider called Stripe, who authorize the purchase on our behalf. We only receive a response from Stripe whether a purchase was successful or failed. (See Processing payments)

When you grant our App access to your photo library

We collect information about the amount of photos and videos you have in your library and provide functionality to make a selection from the photos in your library through our App. We only store photos and videos that you select.

When an order is placed for one of our products

We require additional information to process our orders, for example your name, address or phone number(optionally).

All information that you provide to us must be true, complete and accurate. In case of any changes to your personal information, you must notify us or update your information whenever possible.

The following data may be automatically collected when you are using our app or website.

Technical data when using our app

For instance, we detect the language of your device and use it to display the correct language in our app. We also collect your IP address, device id and other information to identify you and understand how you are using our app.

Information collected through cookies and other technologies

We use cookies for authentication and security to know when you are logged in, show and secure content that is specifically for you and to protect your account. We are using a third party to handle authentication and securing your account. (See authentication by third party)

Next to authentication, we also use cookies for analytics and research and to understand where improvement can be made. This also helps in delivering new features.

Log and usage data

This data is collected, for instance to understand why crashes happened, errors occurred or how performance can be improved.

This information is mainly used to have a functioning App and website. If issues occur, we need this information to troubleshoot and resolve them.

Contact with customer support

When you contact customer support, we keep your request data to resolve your issue and for future reference.

Incorrect or failed-to-deliver personal data

In case of wrong personal data or a failed attempt to deliver data we require to fulfill your order or is required by law, we will start by doing our best to contact you at the provided contact details and look for a solution to resolve this issue (if failure is reasonable to correct). We may also cancel your order and make an attempt to notify you about this cancellation.

Period of data storage

We will not store your data longer than is legally allowed and only as long as is necessary for you to use our website and App. All Personal Data we retain will be subject to this Privacy Policy.

Request for more personal data

We may need to request more personal data than we currently have about you to confirm your identity and to ensure you have the right to view your personal data.

We may use your personal data for more than one legal or lawful ground, depending on the purpose for which we are using your data.

Change of purpose for your personal data

It may happen that we require your personal data for a different purpose or legal ground than we initially obtained it for. In such scenario, we will notify and explain this scenario to you.

We may however, process your data without your knowledge or consent, in compliance with the above rules, and where permitted by law.

How and why data is used (processed)

Information stored from you is used in the following ways:

Account creation and logon

We use your provided username and password to know who you are and to authorize you to access your data. When social logon is used, we use the information you allowed us to store/use from these third-parties to allow access.

Design photo album with the content you provided

When you provide photos, videos and other data for your photobook we use this data to provide suggestions and design your photobook and create the actual product for you.

Feedback

Feedback is extremely important to us and we may use your personal information to contact you about feedback.

Manage user accounts

We regularly check on accounts to keep them working as expected. Also, we have functionality in place to determine how to efficiently store your data. User account data may also be used to monitor user activity, lookup purchase/order records or to handle conflicts that might arise between us.

You hereby grant us the right to close, delete or suspend your account by any means necessary.

Process and deliver orders

Orders placed by you will have to be processed and therefore we need data such as your name, address, photobook information, etc. to create the product you order. We also use your financial and/or transactional data, although we for instance do not store your credit or debit card information provided during the payment/transaction.

We also use your personal data for you to order products again.

Prize draw, competition or survey

We may use your personal data to administer prize draws and competitions when you made the choice to participate.

Security

We try to secure our App and website as much as possible. Next to security measures, we monitor suspicious behavior or violation of our terms or policies to prevent fraud and misuse of your data.

Keep you up to date

Inform you about updates of our App, website or other services. Also changes in our privacy policy and terms can be shared with you.

Manufacturing your product

We share your name, address, photobook / photo’s with our third party printing partner(s) to manufacture and deliver your product on our behalf.

User support

To provide user support, respond to inquiries and resolve issues that occur while using our website or App.

Marketing / advertisements

To send marketing, promotional content or advertisements to you, either from us or our third party partners we may use your personal information. If you agree, we may also contact you about other products that we may think are of interest to you.

Data analytics for App, website or product improvement

We may use your personal information to understand where we can improve our App, website or product.

App and website Monitoring

We may also use aggregate information and statistics for the purposes of monitoring App and website usage in order to help us to work on improvements. We may also provide such aggregate information to third parties.

We offer the opportunity to receive our newsletters. This way, you are fully informed about (discount)offers and other news about our app and services. To ensure your permission, we verify your permission with a confirmation email. We use the email provided to us. Every time we send you a newsletter you have the possibility to unsubscribe from the newsletter.

With whom do we share your data

Personal data may be shared with third parties, with whom we make clear agreements about use and protection of your data. For example, we may share it with it service providers, analytics services, payment platforms, cloud based data warehousing, our printing partner(s) or postal/courier services.

We could also share your data if we believe it is required by applicable law, regulation, operating license or agreement, legal process or governmental request, or where the disclosure is otherwise appropriate due to safety and other concerns.

If required by law, we may share your personal data with a government agency or other regulatory body/organization upon specific request. We may notify you if it is required to do so.

Data storage location and transfer

Your data is stored in Europe Economic Area, but may also be stored outside this area.

Security measures to protect data

We take reasonable security measures, that are known to us, to do our utmost best to protect your personal data. Usage of our App and website is always at your own risk and you should take security measures yourself to access our App from a secure environment. There is always a risk when disclosing Personal Data through digital channels as it is impossible to completely protect technology systems from intrusion.

Your consent to processing your personal data

By registering an account in our App, and submitting your personal information you consent to the use of your data as set out in this privacy policy.

Copyright of personal data

As a user/customer of byPaper, it is your responsibility to provide photos, videos and text that is owned by you or for which you have the right to use it. You should comply with copyright and all laws before submitting this material. More can be found in the terms and conditions.

Sale of business

It may happen that our business is sold to another party or partners up with another business, or a similar scenario. In such case, your personal data will be transferred/disclosed to new partners or the new owner of byPaper.

Your right with regards to your data stored with us (GDPR)

You will have the right to request access to data we stored about you, although this is limited to the view every user will have within our App. If in a reasonable situation, further insight is required, this can be tailored based on the specific request.

You may make a request to update or delete existing data.

You may request a copy of your data within reasonable limits. For requesting a copy of your data, we may require a reasonable fee.

You may file a complaint against processing your data.

You may withdraw your consent, which will mean that using our App will no longer be possible.

Response time

We try to respond to legitimate requests within 30 days. Depending on the number of requests you’ve made or the complexity for the request, it may take us longer than 30 days to respond.

Updates to this policy

We may occasionally update this notice and notify users when making these changes. Depending on the change(s) made, we will notify through our app or by email.
